Part 2: Navigating Building Compliance & Certificates in Western Australia

Understanding the Building Approval Process in Western Australia

In the world of construction and development in Western Australia, obtaining the necessary approvals involves a thorough understanding of regulatory requirements, specifically Certificates of Compliance.

These certificates validate that construction activities comply with the Building Act and are crucial before a building permit, occupancy permit, or building approval certificate can be issued.

This post delves into the different types of Certificates of Compliance, outlining their importance and requirements in the building approval process.

The Role of Certificates of Compliance

Certificates of Compliance serve as essential validations from accredited professionals that a building's design and construction meet all specified regulations and standards.

Each certificate requires:

  1. Signature of a Registered Building Surveying Practitioner: This practitioner must be registered under the Registration Act for the appropriate practicing level—either Level 1, Level 2, or as a building surveying practitioner technician.

  2. Signature of the Issuing Authority: This can be the owner, director, or any party authorised by the building surveying contractor or local government, responsible for issuing the certificate.

Types of Certificates of Compliance

Three primary Certificates of Compliance are integral to the building approval process:

  1. Certificate of Design Compliance (CDC):

  • Purpose: Essential for obtaining a building permit for the construction of any building or incidental structure.

  • Key Elements: It includes a declaration by the building surveyor that the building, once completed according to the specified plans and specifications, will comply with all applicable building standards.

  • Additional Details: The certificate must also document submissions to the Fire and Emergency Services (FES) Commissioner if required, the relevant edition of the Building Code, and any alternative building solutions.

  1. Certificate of Construction Compliance (CCC):

  • Purpose: Required to obtain an occupancy permit for newly completed structures, especially for Class 2 to Class 9 buildings.

  • For Completed Buildings: It verifies that the building complies with its specific CDC, all conditions of the building permit, and is suitable for its proposed use.

  • For Incomplete Buildings: It assures that the building in its current state does not adversely affect the safety and health of its occupants.

  1. Certificate of Building Compliance (CBC):

  • Purpose: Necessary for a range of scenarios including obtaining occupancy permits for buildings not requiring a CCC, approving unauthorized work, and facilitating changes in use or classification.

  • Specifications: It must affirm that the building substantially meets all relevant building standards and that its use does not compromise occupant safety.

Importance of Compliance

These certificates are crucial not only for regulatory compliance but also for ensuring the safety, functionality, and legality of building structures.

They form the backbone of the regulatory framework that governs construction and building use, ensuring that every building that rises meets stringent standards.

Conclusion

Understanding and obtaining the appropriate Certificates of Compliance is indispensable in the building approval process.

For builders, developers, and property owners, these documents are critical in ensuring that structures not only rise from the ground but do so in a manner that is safe, approved, and compliant with all state regulations.

Stay ahead in your building projects by ensuring full compliance with all necessary certificates, thereby safeguarding the integrity and safety of your construction endeavors.
